Representative Matters:

 

  • Represented an Orange County family who became ill as a result of exposure to toxic mold in their home.  Case settled for a total of $900,000.00.  Attorney Court B. Purdy (along with Co-Counsel Jeffrey F. LaFave of San Diego) represented Melissa Celmer and her three boys (Jacob, Kyle and Casey) in a lawsuit against the former of their apartment complex (Robert and Helen Kotob of Los Angeles), the current owner of the complex (KDF North Hills of Orange County), the Property Manager (VPM Incorporated) and the Remediation Contractor (Rainbow Contractor, Inc. of Orange County).

 

  • Represented two homeowners within the Newport Crest Homeowners’ Association in Newport Beach in separate actions against the Homeowners’ Association and the Property Management firms (Professional Community Management and Optimum Property Management).  These cases involved chronic water intrusion issues from “common areas” within the development which were virtually ignored by the defendants and which cause severe microbial amplification property loss and physical injury.  The cases resolved on the eve of trial for $857,000 and $500,000.

 

  • Represented an Orange County woman who became seriously ill as result of exposure to toxic mold and other biological contaminants in her Huntington Beach home. Case settled for a total of $550,000.00.  Attorneys Court B. Purdy and Andrew Gagen represented Niko Black, in a lawsuit against the owner of her home located at 5061 Warner Ave., Unit C, Huntington Beach, California 92649. The home was rented to her by defendant South Warner Business Center(SWBC). As as result of lack if maintenance by SWBC and its agent, Ronald Hseuh (including a failure to inspect the premises and/or conduct preventive maintenance), the home suffered water damage and elevated levels of toxic mold growth which slowly poisoned Ms.Black, causing her to suffer significant and life long personal injuries.

 

  • Represented an Orange County family who became ill as a result of exposure to toxic mold and other biological contaminants in their home.  The case settled for a total of $392,500.00.  Attorneys Court B. Purdy and Andrew Gagen represented Joanne Miller, her two children (Ryan and Allison) and niece, Hayley Smith, in a lawsuit against the owner of their apartment complex (The Palm Garden Apartments Limited Partnership), and the Property Manager (Apartment Management Consultants, LLC).  Mr. Purdy had previously represented another family who had resided in this apartment complex and who had suffered from the same practice of deferred maintenance by the owner and subsequent exposure and injuries as the Miller family. (See, Sienkiewicz, et al. v. Palm Garden Apartments Limited Partnership, et al., Case No. 01CC00072, Orange County Superior Court).

 

  • Represented a family with Andrew Gagen who had suffered for years at the hands of a landlord who refused to fix a chronically leaking roof.  Unfortunately, and unbeknownst to the Elliot family, this water intrusion caused very unhealthy indoor air quality to which this family was very sensitive.  The hoe was located at 608 South Second Avenue, Arcadia, California and the litigation focused on the failure of the landlord to uphold his duties of habitability within the home as required in the State of California.  This case settled short of trial for $325,000.

 

  • Represented a family of three against a large apartment complex in Fullerton for deferred maintenance practices which allowed water intrusion into the home and caused a sever amplification of mold, dust mites and other harmful agents.  This case settled for $350,000.

 

  • Represented a family in a construction defect lawsuit against the builder of their new homes in Corona, California.  The defects in the plumbing resulted in water intrusion and sewage backups and eventually to a severe amplification of mold, e Coli bacteria and other harmful agents. This matter settled for $300,000.
